So last night, I went out to give my sick horse some bute. I had her blanketed and took it off to brush her and put it on our common fence. When I went back outside to get the blanket, it was gone!!!! This morning, I was out giving her medicine again and saw the asshole. I asked him where my blanket was and he went into a rage telling me how much the fence cost. (what a joke!!!!) He did give it back but accompamied by this stupid letter. Now remember this is the neighbor who killed my other neighbors goat and took the collar off the goat and put it on his dog so that they could see it. What a dick. :hammerhea :hammerhea

How about access easement issues?? My mom's neighbor tried to do the same thing, but being as they had been accessing thier property on this road for a period of time, the local planning and zoning board ruled against the A$$hole.

It sounds like you cross his property to access yours...? If it is a dedicated easement it can be revoked. Check your deed or with your title insurance company.

He hates life in general I think. I did report him for having too many horses after he reported my renter for having an extra dog that she rescued. The city gave us 30 days to find a new home for her. She is now in a new home ..........I wish asshole would find a new home. :220v:

If it is the only access to your property and you have used it for some time I would think that easement protacal would be something that a court would uphold. I would call the sherriff/cops if he trys to block access. Guy sounds like a dickhead. Tell him the next time he takes anything our yours you'll call law Enforcement and report it stolen.

I don't know the specifics of your situation, but I have an alley behind my (and my 5 neighbor's) house(s) and some guy from back East bought a trapped flag lot behind, and instead of putting the street on the other side in he sued us to move the alley over 8'. It's been in place for 60 years, but we had to respond to the lawsuit or risk court with no lawyer. If you have an easement or "prescriptive rights" there ain't sh!t he can do if it's over private property. I've been forced to learn a lot more than I wanted to know about this stuff lately to the cost of about $20,000 per person on my side. If you own your property you may have to get a lawyer to shut his ass down.
Any easement you get or have recorded will want to be transferable to anyone you sell your house to. Otherwise he could revoke it from them later. Sorry if this doesn't apply, My kid is home sick and I'm bored :rolleyes:

I was warned about him when I first moved there 2 1/2 years ago but never expected him to be this bad. Right now, I'm trying to get ahold of the city to find out about the easement because that is the only access I have to my horses. Not only that, he can't block it off because he has a huge dumpster in the driveway for his manure and the city picks it up every week. Basically, I don't think he has much recourse except to be spiteful like he is now. He needs to be kicked in the junk.......really hard so he can't reproduce. :devil:

Check with the county.....they do the property stuff. Didn't you get a file folder full of stuff when you bought your house? It should be in there with what the title insurance company gave you.

Is the property zoned for business use or is it zoned for a single family residence? I am not into the legal stuff but it seems that the city may be interested in knowing about it.
ForensicIt's different in Norco, lots of people have horse businesses at their homes so the only thing I can do is find out about the easement and report him when he has too many horses.......lgally that is. :skull:

That name is very familiar. I may know someone who has worked with him in the past. You are not alone...there are 3 houses on our private street. Everyone got along great until an asshole moved into the middle house. He HATES all animals, and should NOT be in Norco. He has killed any chicken that he can catch in his yard. He calls police/code enforcement on everyone around him. Well, used to, they are sick of him. Last thing he did was sent the police to our house and the other neighbor's. The power went out in the entire neighborhood for about 10 min. Everything was out everywhere, it was obvious. He told the police his neighbors had shut off his power and were trying to get him. We basically laugh at him now and ignore him. Everyone hates him and we are hoping he moves to a gated, security retirement community soon. That's where he belongs.

My wife has used this many times in regards to our neighor. Topless is right, this is a mixed use equestrian area and I am sure the business is legit. If he is only on 1/2 acre, 5 horses is the limit UNLESS he has a conditional use permit for more. Hard to explain, have been here 12 years and am still learning the politics in Norco.

Topless it sounds to me like you have a Easement by prescription-When the claimant has made use of another's land for a certain period of time as defined by state law, an easement by prescription is acquired. This amounts to a limitation on the landowner's use of the property. In Texas, this prescriptive period is ten years, but of course CA. may be different. The claimant's use must have been continuous, exclusive, and without the owner's approval. Additionally, the use must be visible, open, and notorious, so that the owner could readily learn of it.
If your easement has not met the prescriptive time period perhaps you could use a concept called tacking. Basically that means that successive and uninterrupted occupation, or use by different parties may be tacked on, or combined, to reach the prescriptive time period.

by definition it sounds like you have a prescriptive easement which translates to: rights obtained in law by long possession. Occupancy for the period prescribed by the code of civil procedure (5 years in California) as sufficient to bar an action for the recovery of the property, gives title by prescription.
As someone posted above if time is on your side, your in the right. Even if you have lived there for less than 5 years, the previous owner may have used it too.

Sounds like an appurtenant easement for necessity. However, none of us have the facts, so it's a little hard to judge without knowing the specific use of the property. It is my understanding that most all easements are perpetual unless there is an expiration date in writing?

easements useuly can only be revoked by the city pending an hearing and by a judge, since it had to be oked by the city to begin with. check with your local city hall or public works dept at city hall , or building and saftey. :cool:

Actually cities have nothing to do with easements written or obtained between private land owners. They only get involved with public right of ways and city owned utilities. Cities only get involved with private land if your are doing a subdivion or lot line adjustment or a dedication to the city.
If it doesn't have anything to do with a public right of way (street, etc.) they
will have no knowledge of it.

I feel bad for you Topless. We had one of those neighbors for a few years. He lived on a 5 acre ranch and didn't like dirt and hated horses. Always walked around in white shorts and sandals. LOL He had an easement to use our driveway and we nearly went to court over it. We wanted to put a gate up and give him a code and clicker to open it. He went ballistic! Come to find out, we can do anything we want, as long as we don't keep him from accessing his property, since we were still offering him access, he didn't have a leg to stand on. He yelled at Jeff, "I don't think your wife understands what an easement is." Yeah, I'm an idiot. Chauvenist ass. Glad he's gone. He moved to Sun City. The new people are way cool.
Your grant deed will have a legal description fof your property and if you have a legal easement already, it will be there in the description under a "schedule A" most likely.

I sold and left California because the neighbor family turned psycho on us and my wife just couldn't mentally toughen herself enough to either do battle or ignore and peacefully co-exist with them. Neighbor problems suck and it's usually impossible to effectively come to an agreement or understanding when the neighbor is basically a bully. That the neighbors made my wife so unhappy made me want to kill someone or burn their house down, but we could have ended up like the Hatfields and the McCoys and it was just easier for us to move and keep our sanity and civility.The loser psycho neighbor family had owned their house since it had been worth 10 grand, it was termite infested, and none of them had the income required to borrow any meaningful amount of money, so we knew they would never move. We sold the property to a guy named Habib that immediately converted the garage to an apartment and moved his two son's families in. He removed all the shrubbery, put spiked wrought iron around the whole property and painted it a pukey color.

Just found out it is separate property. He might have to take me to court to get me to quit using it though. I'm putting my horse to sleep in the morning and the vet has to come out as well as the animal removal people. What is he going to do then? Be a dick to them too? :hammer2:

Topless, do you have electricity/gas on your property that is supplied by a PUBLIC utility???? Utility has THE RIGHT to use the easement to access your property to check ELEC or GAS meters, in creating that easement it also gives you the right to use it....

After purchasing their property, Jimmy Grabach locked the road gate between the two parcels. The Larsson Family Trust sued the Grabachs for an easement by necessity to their landlocked property that lacked access to a public road, or for an easement by implication due to the previous use.
Evidence showed the two parcels were created in 1942 when Nelson Nathan Logan died without a will. His property was distributed by the probate court to his heirs, each receiving adjoining parcels.
Douglas Larsson inherited his 160-acre property in 1995. When the Grabachs bought their adjoining parcel in 1998, they were aware of the dirt road used by the Larssons.
If you were the judge would you grant the Larssons either an easement by necessity or an easement by implication over the Grabach property?
The judge said yes.
The general rule is all properties should have access to a public road, the judge began. In this case, he said, the parcels were subdivided in 1942 after Logan died.
The landlocked parcel used a dirt road over what is now the Grabach parcel to reach the public road, the judge explained. Until the Grabachs bought that adjoining parcel in 1998, there were no problems using the dirt road over what became their property, he noted.
An easement by necessity can often be created over an adjoining parcel to reach a landlocked parcel, the judge emphasized. But that is not required in this case, he commented, because after 1942 there was a dirt road over the Grabach property to benefit the landlocked parcel.
When a property owner's existing use of part of an adjoining property for access is obvious, and the easement is necessary to reach the quasi-dominant tenement — the land to which the easement is attached — an easement by implication exists, the judge ruled.
Therefore, the Larsson Family Trust is entitled to an easement by implication (rather than an easement by necessity) over the Grabach property to reach their landlocked parcel, the judge concluded.

If you were the judge would you grant the Larssons either an easement by necessity or an easement by implication over the Grabach property?
The judge said yes.
The general rule is all properties should have access to a public road, the judge began. In this case, he said, the parcels were subdivided in 1942 after Logan died.
The landlocked parcel used a dirt road over what is now the Grabach parcel to reach the public road, the judge explained. Until the Grabachs bought that adjoining parcel in 1998, there were no problems using the dirt road over what became their property, he noted.
An easement by necessity can often be created over an adjoining parcel to reach a landlocked parcel, the judge emphasized. But that is not required in this case, he commented, because after 1942 there was a dirt road over the Grabach property to benefit the landlocked parcel.
When a property owner's existing use of part of an adjoining property for access is obvious, and the easement is necessary to reach the quasi-dominant tenement — the land to which the easement is attached — an easement by implication exists, the judge ruled.
Therefore, the Larsson Family Trust is entitled to an easement by implication (rather than an easement by necessity) over the Grabach property to reach their landlocked parcel, the judge concluded.

That is considered a conflict of interest. How could we at Jones, Jones, and Jones equally represent two parties that are on opposite ends of the spectrum. In this case, we have our client Mr. Waldt, who is an honest, hard working man who is trying to provide for his family. And we have Allllllison, who frankly is a vagrant, harassing, low life, trouble maker who insists on breaking the law and violating our clients rights. So last night, I went out to give my sick horse some bute. I had her blanketed and took it off to brush her and put it on our common fence. If You want to spend a little time at the game of @$$hat neighbor, Go down to the city and pull a city bussiness lic under this name as well a ficticious business name. I doubt like hell he is running a legit operation here as most horse boarding operations are a cash business. It is likely he carry's no liability Ins on this operation and it would be childs play to make his life hell.
As Angie mentioned earlier we had an @$$hole next door that thought he was a big shot. My 7 year olds go cart was his last straw. It is funny how much dust dad can stir up every time he got his Lexus detailed.

Your property. tell him to piss up a rope and to keep his animals off your fence. i.e. put up your own damn fence. I have been in property arguments with all of the neighbors. some by my fault, some theres. Bottom line is that if you put up a fence it is best to do it 6" on your side, IMO.
