DMV took money out of my bank account to pay reg fees on a truck I traded here in Arizona last year. Just got a notice from my bank in Cali that I got hit for $805 from the focking state
How in the hell can they do this? I have filed TWO release of liabilities when they sent me collection notices to pay the fees. Both showed that I traded it in in Arizona.
Anybody ever heard of this? WTF do I do now?

Enjoy the politely mailed map of Lake Powell I finally mailed to you today when you get it?
That might make you feel better but it won't help your bank account. :)

my son got nasty gram after nasty gram from the DMV after he moved to Nevada and switched his registration there. He didn't have the problem of the money being taken from a bank account because he doesn't have an account in this state.
They are also trying to claim he owes back income taxes even though he hasn't resided in this state since 1998. This state SUCKS!!!!!!! :burningm:

Unfortunately, I kept this account open but its not my primary account. What I am most worried about is getting a collection on my credit. The focking nastygram has my SSN on it so they can report to the credit bureaus if they want to. I'm so pissed I can't think straight. :220v:

Hopefully you kept copies of the release of liability statments. You'll probably have to file a claim and submit statements, but you'll eventually get your money back.

Take all your documentation down to your local DMV, Ask to he the highest ranking manager in the office and then demand a refund asap and close your account.... Never knew they had accounts

Problem is that I don't live in Cali anymore. No way I am driving to CA and waiting in line at the DMV. The AZ DMV is not linked to the CA DMV obviously. What really blows is that I just got one of these notices on my car (which I still own) and I just sent them a copy of the reg showing that its in AZ now.
BTW, I don't know how they got my bank info. I never gave it to them.

Actually, this is the way it is set up. DMV sends collection info saying you are past due on reg. Once it goes past so many days they pass it off to the Franchise Tax Board. It was actually the FTB that served my bank with a collection demand and my bank sent a copy of the FTB demand to me along with a letter that says state law requires them to withdraw the funds. I looked it up on the web, it is a tactic they are using. Fock the People's Republic of Kalifornia. This is big brother at its worst, just step in an steal your money anytime they want.
This is BULLSHITT!!!!!!!! I am focking pissed!!!!!! :2purples:

Maybe you can email them or go to their website and file a complaint without coming over here. Otherwise, come on over and we'll have a beer waiting...

Do you have an AAA Membership? They are linked to the DMV and since they are nationwide, maybe they can work with an AAA office in Cali. Just a thought...

Yes, good idea. Thanks

Get ahold of your Senator or Assemblyman now. Call their office and follow it up with an Email. Keep on them. They'll get it handled.

I don't think this is just a California thing guys. I was screwed by arizona for back license fees on the boat I bought. There is a reason they took it or they wouldn't (and couldn't) have taken the money from your account. Sorry, but I have been down this road before and it is what it is. :frown: v-drive

No it isn't what it is! What are you trying to say? A reason? Lets see, I trade the truck into the dealer here in AZ with current Cali registration, 4 months later the tags in Cali are due and they are coming after me when I no longer own the truck. WTF?
The REASON is that they are stupid minimum wage DMV employees that don't give a shitt about anything but when the next 15 minute break is.

They sure will, they just took ours. We are going through the same situation, except we gave a 56 bug to our son, who lives in AZ and we made sure he went to the DMV right away, all the good stuff, and we still get stiffed.

My daughter sold a MC in Ca 2 years ago (I was co owner on the pink). She sent in several release of liab. paperwork. The buyer got a parking ticket 1 month later. We both got a letter from dmv (or the court ) saying we owned the ticket. We went to dmv, explained and turned in new release paper. Didnt hear ftrom anyone for about 8 months, then letter came from tax board saying $165 owed and will be taken out of tax return money. Sent in all proof, bill of sale etc, all seems to be fixed after 1.5 years.
Good luck !!!!!!!!!!!!

I had this same thing happen to me. We traded in my Explorer a couple of years back but I would keep getting registration notices from the DMV for it. I assumed that sending in the release of liabilty was enough but I kept receiving the notices and kept sending in the release and they finally reported it to the FTB and they sent a wage garnishment to my work. That really pissed me off. I got the garnishment and the whole thing resolved by calling AAA and having them help (they are much more helpful than DMV folks)and then had to contact the dealer that we traded it in at and make them file the correct paperwork to release me as the registered owner. I had copies of every (7 to be exact)release of liabilty and a copy of the purchase contract for the new truck that showed the Explorer being traded in.
Bottomline is I just had to show proof and it was resolved.
The FTB was actually quite pleasant to deal with, I was able to get them to suspend the garnishment and give me the chance to clear it up.

Ya, but if you talk to V-drive you deserve it.
Well here is an update. I called the dealer that I traded to and they told me to pound sand. "Not their responsibility!" WTF? Why did I sign a POA at the dealer then?
So I called FTB and actually got to talk to a live person. She told me that the DMV made a mistake and cleared my past due reg 2 weeks ago. Well the money was taken out less than one week ago. So she says they will contact my bank and reverse the charge. No Apology, no nothing. Rat bastards.
So now I am holding my breath waiting for the $$.
All you folks moving out here better be sure the DMV has the release or copy of the AZ title (certified mail or walk it in) so this won't happen to you.
