Man's lawsuit argues right to be drunk
Boston partyer says cops violated Constitution by arrest on private property
BOSTON - A man arrested when police showed up to break up a New YearÂ’s Eve party at a friendÂ’s house has filed a lawsuit, arguing he had a constitutional right to get drunk on private property as long as he didnÂ’t cause a public disturbance.
Eric Laverriere, 25, of Portland, Maine, was taken into protective custody by Waltham police and locked in a cell for nine hours until the effects of the alcohol wore off.
Legal experts said his lawsuit, filed this week in U.S. District Court in Boston, is the first to challenge a state law allowing police to lock up drunk people against their will for their own protection.
Laverriere argues that the Massachusetts Protective Custody Law was written to combat public drunkenness and that the police had no right to use it to take him from a private residence. He also says he had planned to spend the night at his friendÂ’s and wasnÂ’t going to be driving anywhere.
“One thing people should be able to do is drink in their own house,” Laverriere told The Boston Globe. “That’s the beauty of the land of the free.”

I have never understood why cops are able to arrest you, in your own yard, for being "drunk in public."
If you ever call the cops and have been drinking; invite them in but never go outside. Not falling for that trick!
...not that I would know ANYTHING about the above scenario....

but I guess it's something like this,
it's ok to be drunk "IN" your home, but outside the structure in public view would be considered Drunk in Public, or at least disorderly conduct.

I don't know about other states, but Ca. can arrest you 10 miles into your property for DUI. Whether it be a dirt bike, snowmobile, car, truck, tractor doesn't matter. Now how they found you is usually the result of an accident where emergency services are requested, and if you're OUI/DUI, you're gonna get charged..........MP

I dont see how they can arrest you in your own home unless you were making a public disturbance, or they got you for providing to minors...they cant come in your home without permission... but like c-2 said...dont go outside... :D

Arizona has no "Drunk in Public" law. Only "Disorderly Conduct" if the drunk is causing a disturbance.
In the town of Parker though, they have a City Ordinance against being "In public, in an Intoxicated State within 1/2 mile of a School". Since the town is only 1 square mile and there's 4 schools .... well, you do the math.
The only way a person can be arrested on their own property while drunk, is if they are under 21, or committing another crime, such as Domestic Violence, Disorderly Conduct, etc.
As far as DUI, the law says "anywhere in the State". So technically if you're hammered on your riding mower in the back yard you could be arrested and charged with DUI.

Here's how they can arrest you in your own house for being drunk.
Guy kicks gf out of house. She's not on the lease and refuses to pay rent plus she's a cheating bitch. GF gets enraged and begins to brake shit. Guy calls cops and cops come to house tell GF she has 15 minutes to get her shit and go or if she remains civil and guy agrees she can remove her things while guy is gone. Guy agrees to let girl get her things under the condition she is gone by the time he returns from a party.
4 hours later guy returns from party to find gf, gf's mom, moms bf, and 3 people he's never met literally ransacking his home. They are taking everything couches, lamps, tables, you name it. Keep in mind none of these things belong to herGuy gets into altercation with one of the girls friends and then calls the cops. Cops comes (turns out gf was boning a cop who just so happens to be on duty and shows up) cop comes into house throws guy on ground handcuffs him and locks him up for being intoxicated in his own residence.
15 minutes after being cuffed guy arrives at county jail where he is given a blood alcohol test and does .058 not even enough to get a DUI in the state.
After spending 8 hours in detoc guy calls mom to wish her a happy mothers day and request that she pick him up from jail.
Sounds pretty wrongful to me. But hey the laws the law right and who's going to argue with the law?

If they show up make sure the gates are locked. It is my understanding that they can not enter the backyard if the gates are locked but if they are unlocked they can walk back there on there own and do whatever they want.
Also, if the cops show up just comply with whatever they ask, usually over a party they will come once and ask you to keep the noise levels down then leave. You do what they say and they wont mess with you. Don't do what they say and who knows what they'll do.
Also, make sure none of the officers responding are sleeping with a gf that you are on bad terms with.
I wonder what a cop would do if he showed up at your house and you said to him "officer before I will talk to you I must first know something; have you or are you currently sleeping with any of my gf's?"

I'm really not sure, it's not like I'm constantly being arrested. I'm just telling you what my lawyer told me once, never leave your house if you think they might arrest you or if you're prone to fits of being an ass around police. Open the door, talk to them, whatever, but don't go outside. If they have enough to arrest you, they'll get a warrant, otherwise, why put yourself in that situation. The last time I did not follow my own advise, it cost me $6000 to bail out ($60k bond) and the only charge they ended up filing was resisting (not the major charge I was booked on). Staying in my house would have likely ended the situation, my lawyer said there was no way they ever could have gotten a warrant, as evidenced by the fact that I was never charged with anything.

Well thanks for the advice, but only in and out access to the party is through the gate, my house is going to be off limits.
This party is for a friends Bday and her friends are very distruptive and tear things up, so my house will NOT be trashed by them.
Well I will inform the neighbors and hope they are ok with it, in very good terms with the neighbors

It's a long, convaluted story, but yes, I was in the process of getting arrested, BECAUSE I came outside and was a dick to the cop. Had I NOT resisted, and by resisted I mean passively resisted getting in the car while this jackhole lets my two kids run around in the street, I would have been left in the car to stew and then either warned or cited with a misdemeanor and released. As it was, they beat me down in the street, had to get an "OK to book" from the ER and then maxed me out when they booked me with a felony and the throwaway resisting. The only thing I was charged with was PC148, misdemeanor resisting. The main booking charge wasn't even reduced, it was just completely scrapped. They couldn't even make the misdemeanor charge against me, but by resisting, I didn't leave them much choice.
What the hell did you do in the first place?

I guess they dropped some charges on him because they were lame.. but .. they wouldnt have tried to lock him up if they had not intended on arresting him in the first place...
My point is.. they can twist and do anything they want.. and it always boils down to your word againt theirs..
its just easier to be honest with them and cooperate.. I have never been in any trouble when I took that rout

I locked my car with my kids buckled into their seats watching a DVD and went into the supermarket to use the ATM. I was gone approximately 4-5 minutes, just long enough for one person to use the ATM in front of me. It was 72° outside and both A/Cs were on in the Expedition. It was about 50° inside the truck. :D When I returned, there was a crowd of people around my rigs, so I'm like "OK, WTF?" This lady starts ranting and raving and I was like "Look, bitch, mind your own business." She says "I'm calling the cops." I said "Go the f ahead, dumbass, I'll wait." And I did. About 15 minutes later, two firetrucks come rolling up and 4 FFs get out, come over, ask what's going on. I explain. The main guy just rolls his eyes like "WTF are we doing here?" He says "Can I check the kids out?" I said "Sure, go ahead." He goes through the motions and says "These kids are fine, we're out." Three of them are heading back to the truck and one real young, new FF is writing down my plate. I said "What are you doing?" He says "Just taking down your plate for the future." Then he starts lecturing me on the dangers of leaving your kids in an air conditioned car for 5 minutes on a 72° day. I said "Do you have kids?" He said "No, not yet." I said "Let me know when you have some, then I'll take parenting advice from you." He said "I can call the police and report you." I said "Go ahead." Then he refused to get away from the back of my rig, so that I could leave. I asked him "nicely" three or four times to move and he was just taking his sweet ass time. I finally took off my sunglasses and hat and said "Look, I asked nicely, this is your last chance, move or I'll move you." He moved and I left. About 30 minutes later, the cop shows up at my house. The rest you can probably figure out.

The cops come to my door, knocks and then backs off to the street. I opened to door and he says "You know why I'm here?" I said "Yeah, I can guess." He said "You want to come outside and talk about it with me?" I said "Nope." He said "I can come in and arrest you in front of your kids, you want that?" At this point, I'm thinking he's full of chit, because my kids are not in emminent danger and the FF already took the report and said my kids were fine. But, I didn't want to push the issue, so I went outside. Now, both my kids are outside on the driveway with me. The guy says "You want to tell me what happened?" I said "You want to tell me why you're here?" He said "To talk to you." I said "Specifically, what charge are you here investigating?" He goes all Billy Badass on me and says "Sir, I'm here investigating a charge of felony child endangerment." I said "You've got to be kidding, you can't make that charge." He says "It doesn't matter what I can make, that's what I'm here for." I said "Well, then you can talk to my lawyer." He said "Turn around and put your hands behind your back." I complied and everything was golden up until the point that he's letting my 4 and 2 year old run around the police car parked in the street. Then I just went nuts. It took a whole grip of them to beat me up and get me in the car.
OOoooh not good, kids running free at that age.

Now they should freak if its very hot out and then left them in the car, but geesh they are cool.

We can't spank our kids in public (although I do from time to time) because some people beat their kids to death. We can't leave our kids in the car at a convenience store because some moron locked her kids in the trunk and went to work all day. I also know the difference between hot and not hot. 72°, according to my in car thermometer, is not hot. Today, it's 92°, that's hot.

The guy was in someone elses's house, not his own home.
I can see being arrested if the property owner requested it, but I can't see the cops being able to make that call on thier own!!!
If I'm on my own property, then I should be able to drink, IMHO.

Basically a cop can do any damn thing he wants (except to OJ). It's a cryin' shame that we let them get away with the shit they do. If you are a law abiding citizen you shouldn't have to put up with this crap period! Now, I'm not talking about people who break the law so don't start yelling at me. Leaving toddlers in running vehicle, locked or not, probably isn't the smartest thing to do. Just a little constructive critisism. Cars do get stolen, especially ones that are already running.

Probably true considering the lady in SD did that it and someone DID drive off with the vehicle and the child, but luckily the dipsh!t pulled into a parking lot and abandoned the vehicle and child.
But not everyone gets lucky.

People also get robbed at gun point at ATM's. Should I start calling the cops on people for using the ATM since they are putting themselves in danger?

2 and 4 year olds don't decide, on their own, to stay in the car alone. I wouldn't call the cops if I saw this, but I would stay around to let the person know that it isn't too wise.

Let's look at things from a statistical stand point. Statistics will show that a child is more likely to be injured or killed in a car accident then they are to be abducted while sitting in a parked, locked car for 3 minutes in front of the super market.
So should all these crazy people be able to call the cops on ShockwaveBob when they see him rolling down the street with children in the car? Afterall, 2 and 4 year old children are to young to decide whether or not they want to have their lives jeoparized by being taken for a car ride that could potentially kill them.

Ok OK I think its enough, things happen and change the way most people think, but no one should be able to call the cops without suffient eveidence of a crime, not calling the cops cause they see something they do not like. Geesh damn people

I think that is the resposible thing to do. Teach them early. That way they can pick uou up from the bar. :D

BTW, you know your first mistake was knowing more than the cop... that will lead to a beat down just out of spite ;)
Rule #1, never lead on that you know more than the cops.. thats your lawyers job!!!....
The police have been to my neighborhood three times in 6.5 years, twice for me. :D
Oh, and the guy that arrested me felt bad for me after getting to know me at the ER. He actually called his Lt. to see if he could just cite and release me from the hospital. I could actually hear his boss yelling over his cell phone "F**k no, that sonofabitch is going to jail!!!!!!!" :D
