OK fine, I'll poast it here since she doesn't lurk here. A girl I work with has a 21 year old flighty daughter with a 2 year old daughter. She (the daughter0 has been split up with the father for at least 2 years and last year he took daughter to court and won custody of baby girl. Now the court papers say he is not to leave the state with the baby unless he has permissin from the mom or the court. He has neither but is moving to Utah the end of the month. What can they do to prevent this? I know he will be in contempt of court but what legal action can be taken?

The Riverside County D.A.'s office has a child abduction unit. She may want to call them and see what her options are.

She's in SB county. The court order does say he can't take the baby out of state. All I'm doing is giving her the info. She needs to be more proactive in this situation. This is an obvious reason that children shound NOT have children.

This happened to me when I was first divorced years ago..wife moved away when she was ordered not to......

I'm not sure there's much she can do, legally. He hasn't actually violated the court order until he moves them out of state. Once he moves them out of state, he can be charged with child abduction, a much more serious charge than contempt of court. She should obviously consult a family law attorney, maybe the custody order can be modified so that he can't take the child out of state, i.e., custody to another relative.
I agree with Bob here, I used to work in Family law and this happens all the time. She should definitely consult a family law attorney or call the DA's office like someone already suggested!!!
Just think....I might be able to answer crim law questions soon!!! :D

The father....Father is 22 and just had another baby, mother is 21, grandmother just turned 40. The all started too early in life to have kids if you ask me.

Well, all I know is its going to cost her a lot of bones for the lawyer. Hope she has a job and willing to pay for the cost.

So is dad more stable than mom???
Speaking from family experience, she's looking at least in the 5000.00 dollar range just to start the process and the initial court hearings.

She has no $ and yes, the dad is more stable. She just doesn't want him to take her out of state.
