Traveling from the Carlsbad Airport in San Diego, the Hawker 800XP jet struck a glider in a mid-air collision at 16,000 feet over the Pine Nut Mountains southeast of Carson City.

Somebody did not have their mode C transponder on, or the Hawker did not have collision avoidance install or not wotking. I suspect the glider did not have mode c transponder on.
That must be one huge story to tell those back home in Japan, bailing out of a disable aircraft at 16,000'

If you've ever come through there... the gliders are like flies in that area... I've come pretty close a couple times to tangling with a few while headed into Reno... it's pretty wild.
Gliders are exempt from transponder rules... I think... Regardless, under VFR rules, it's the pilots responsibility to see and avoid...
Everyone in both airplanes were flying under a lucky star that day.

a) at or above 10,000 MSL, over the 48 contiguous, excluding the airspace below 2500' AGL. There is an exception for gilders.
I'm "not sure" but I think the glider was above 2500' AGL in that area at 16,000.

The glider exception comes in due to the fact they weren't originally equiped with an electrical system...
FAR 91.215 - (5) All aircraft except any aircraft which was not originally certificated with an engine-driven electrical system or which has not subsequently been certified with such a system installed, balloon, or glider—
shall have a transponder blah blah blah...
ATC usually calls primary targets (skin radar reflections) in that area as you approach Reno and let's you know that gliders are in the area.

Good thing Hawkers are built like a tank... somebody tried to shoot one down several years ago with a stinger missle somewhere in Africa... the airplane made it back to the airport for a landing, without one of it's engines, was repaired and is still flying.
