I have an employee that is on Salary and I would like to put this person in outside sales. Commision only. Can I do this? Where does a person go for this info so I don't get in trouble and shit.

Ok, I need to know some things here....
was the employee orginally hired on salary and now you want to change them to commision only??
Is the employee contesting?
Is there an original contract with compensation terms?

ok, noone will give me a straight answer becuase you are in Nevada. Try looking it up here:

My instinct on this from what I have found out, for CA mind you, is no, you cannot do it.

No contract for salary, started as salary from the beginning.
I finally got a hold of a human being at the labor board just now and the person there tells me, no problem.
Just need to give written notice 7 days in advance, pay at least minimum wage and if the employee declines, oh well, you offered them a job and they declined, that is up to them, they resigned then.
I'm sure I can still get sued, but we will find out.

Depends on who you want to believe. I have heard it is an "at will" and a 'right to work". Hard to get a hold of anyone that I have confidence in.

Sounds like they are an at will state, based on what he is told. If the employee doesn't like it then it is compulsory resignation.

Hey Bill that sounds right....been in HR for @&+ years. Call me if you need any other help...and the general rule of thumb in Nevada is that you can do whatever you want... :)
