I had three friends out on one of my boats 2 years ago. One was driving, they say around 40ish, the other two were sitting on the back deck with their legs inside the boat and feet resting on the back seat. They hit some good size boat wakes kind of crossways and the two on the back deck were thrown overboard. One of them came up, the other one... his body surfaced a few days later... Legal or not, everybody is inside my boats while underway.

AZ claims wakeless speeds are ok (if memory serves)
CA claims under power = ticket..
Lake/River is patrolled by both so you have to go with the lowest common denominator (CA law), so nobody is allowed up on the gunnels or on the engine hatch while under power.

We asked the Havasu boat cops the same question last month. They said it's OK as long as you're wakeless. I still don't allow it though...

My rule is, if the motor is running your butt better be in a seat. Keep it simple and drunk people will understand.;)
