Southwest Valley drivers heading to lakes should be aware of sobriety checkpoints planned on Memorial Day.
A roadblock will be set up near Lake Pleasant to catch tipsy drivers from 3 to 7 p.m. Monday on Castle Hot Springs Road west of the lake.
In addition, there will be patrols on Arizona 74, a major route to the popular recreation spot.
The operation will be staged by agencies that participate in the West Valley DUI Task Force.
At the checkpoint, every vehicle will be stopped. If an officer detects any signs of trouble, such as a driver smelling of alcohol or empty beer cans in the vehicle, further investigation will be conducted to determine if the motorist may be driving under the influence.
In 1990, the U.S. Supreme Court upheld the constitutionality of roadblocks set up to find drunken drivers. The justices ruled 6-3 that preventing "alcohol-related death and mutilation on the nation's roads" outweighs the "slight" intrusion on drivers stopped at sobriety checkpoints.
The ruling upheld Michigan's checkpoint program and, by extension, similar operations in other states, including Arizona.
The Arizona Supreme Court reached a similar conclusion in 1984, overturning a Pima County ruling finding such roadblocks unconstitutional.
Under Arizona law, motorists are presumed intoxicated if their blood-alcohol level exceeds 0.08 percent. If it tops 0.15 percent, they are presumed extremely DUI, resulting in enhanced penalties.:idea:
On Memorial Day last year, the West Valley DUI Task Force arrested 10 people with an average blood-alcohol level of 0.14 percent.
