Teen skips preliminary trial in Movies 10 case

One of three teenagers suspected of assaulting a 16-year-old Redding boy outside Movies 10 last month gave up his legal right to have a preliminary hearing Wednesday.
Thomas Sebastian Duncan, 16, who had been scheduled to have his preliminary hearing today, now faces a Dec. 4 trial date, said Deputy District Attorney Ben Hanna, who is prosecuting the case.
Duncan, who is being prosecuted as an adult, is free on $50,000 bail, Hanna said.
The Redding boy is charged with three felonies: assault with a deadly weapon, attempted robbery and battery with serious injury in connection with the alleged July 17 beating and attempted robbery of Levi Scott Snyder. He's also charged with two additional charges alleging Snyder suffered injury in the alleged attack.
If convicted of all the charges, Duncan faces a maximum seven years, six months in prison, said Hanna.
Police have said that Snyder was reportedly accosted by the boys outside the Churn Creek Road movie theater and was knocked out by a punch during the alleged assault. He underwent surgery for cranial bleeding after his head hit either a wall or the pavement during his fall.
He has since been released from Mercy Medical Center in Redding
