Motorists Spot X-Rated Films in Some Cars

DETROIT - Andrea Carlton hadn't planned on telling her daughter about the birds and bees until she was 8 or 9. But that changed the night 4-year-old Catherine spotted a porno movie flickering on a screen in a minivan nearby.
"Just like there's no windows in a strip club, you shouldn't be able to see inside windows in a car when they're watching X-rated movies," said Carlton, a 26-year-old from Gurnee, Ill.
More and more Americans are buying vehicles with DVD players, usually to keep the kids entertained. But an increasing number of other people on the road are catching a glimpse through the windows of more than just "Finding Nemo" and "SpongeBob SquarePants."
Depending on where they are driving or parked, motorists could face fines and even jail time for screening X-rated stuff. But where the law may not be clear, some are calling for tighter regulation.
"Residents should not be subjected to those obscenities," said Flint City Councilwoman Carolyn Sims, who is examining whether an ordinance packing a $500 fine is needed. "They do have a right to have peace and tranquility and not to have this exposure to sex in their face."
A driver in Schenectady, N.Y., was arrested last month after rolling past police with a DVD titled "Chocolate Foam" playing on the passenger-side sun visor in his Mercedes-Benz, authorities said. The movie also was rolling on screens set into the car's headrests.
The driver was accused of breaking state laws prohibiting watching TV while driving, as well as another law making it illegal to exhibit sexually explicit material in a public place.
"The detective had a clear view of what was playing through the window. Anyone walking by on the street could have see it," Schenectady police Lt. Peter Frisoni Jr. said of the nighttime traffic stop. "If he had dark, tinted windows where you couldn't see in, that wouldn't be a public display."
As for Carlton, she and her husband were driving in the Chicago suburb of Buffalo Grove when Catherine glimpsed the sexually explicit movie. The experience last fall upset the girl and angered Carlton.
Carlton and her husband sat down with Catherine and offered the best explanation they could. Since then, Carlton has spotted other motorists with explicit movies playing, including a couple watching from the back seat of their car in a store parking lot.
"You're not allowed to have sex in your car, so why are you allowed to watch it?" Carlton asked.
Most states, including Michigan, have laws that make it illegal to watch TV while driving. Laws governing the exhibition of pornography vary by state, but experts say they could be applied to drivers as well.
"I think those restrictions would apply if the content is located in a vehicle," said Jeff Matsuura, director of the law and technology program at the University of Dayton. "You have effectively moved beyond the privacy of your own home."
During the day, it is often difficult to see what is playing inside another vehicle. But at night, the screens are easily visible from a passing car or a vehicle stopped alongside at a traffic light. The screens are also getting bigger.
In Flint, Sims took up the issue after hearing from a woman who was driving with her 5-year-old when she spotted porn playing on a vehicle's 13-inch TV screen. A police officer who happened to see the display pulled over the driver, Sims said, but let him off with a warning.
To Sims, a 23-year police veteran who retired in 2001, playing an explicit movie in view of other motorists or pedestrians is akin to flashing or having sex in a public place.
But Michigan State Police, who have not had any cases of in-car porn, say playing an X-rated movie might not be easy to prosecute unless it can be proved that the motorist intended for others to see it.

It's not illegal as long as there is other passengers in the vehicle. If it is just you, most cops get a little pissed.
A inattentive driving ticket, and / or obstructed vision ticket could follow.

People shouldn't be driving by cars and watching their TVs anyway, they should keep their eyes on the road. I see no problem what so ever with it, you bought it, its in your personal car, for your audience, not for the MILF driving by. She's just jealous...she remembers her porn days :D

..oh shit that reminds me of a funny story about 2 years ago. I pulled out from like Needles heading back to Laughlin during the river run..my buddy pops a porn in on the overhead screen and we's all ****ered up yahoo having a good ole time. Cars kept rolling up laughing, bikers laughing...but the fun kinda stopped when I had to lock em up to avoid a rear-ender. Don't try to watch the porn while driving...:D

You know, I ussually do not get into threads like this,.....BUT, I have a 3 year old daughter. She picks up on EVERYTHING. The LAST thing I want her to see as we are at a red light is porn.
I don't mind it on tv or on the radio. I can change the station. In this situation, there is nothing I can do to keep my daughter from seeing. I cant even change lanes or pull away. That, I have a problem with.
If I did not have my daughter, I may look at it differntly....
But I do.

I think you hit it on the head. You can tell who has kids in this thread.
I will have to take the side of my kids should not have to be subject to that stuff while I'm as a stop light. I can keep um from watching it on TV at home and I can keep them away from the sandbar on Memorial weekend but I can't keep um from glancing into the car next to us at the stop light.
Its funny how your whole outlook changes when you have kids.

Everyone talks about your right to privacy, it is your car and you should be able to do what you want , and i agree to a point. In the interest of saftey, in make take a passing driver by suprise and make them lose their concentration and cause an accident, so it now has endangered the saftey of the general public, now it is not a matter of privacy ,it is a matter what is good for the public as a whole. You have the right to walk around your house nude as long as it is not in view of the general public , especially a child, if convicted of such a crime exposing a child to nudity or a sexual act , you would be listed as a sex offender. It should be the same in a vehicle , if you want to show porn, then make sure your windows are dark enough that it can not be seen from the outside.As a parent of 2 children these are my thoughts. As a pervert i am all for porn , thats why my windows are limo tint.:D

Ya, its about class and respect. Unfortunately it seems that people are lacking both more and more. Just like the dirt-bag that has to play the Gangsta Rap MF this and MF that at 10+ while you are at the gas station. Just your basic dirt bag with no respect.
I am all for reducing the number of laws we have in the country but when it comes to protecting kids from seeing this type of shit as well as very violent stuff on mobile videos I would have to be in favor of some type of law that says you have to have it out of view of adjacent vehicles and pedestrians. Were talking about young curious kids here not nosy adults. If you can't see this point then I think you have some ****ed up priorities.

How many of you who seem to be in favor of showing porn to little kids and grandmas have little kids? (I assume you have grandmas).
I don't mind watching it, but sure don't think its appropriate to show it to kids.
Its illegal already to let minors see porn, this is just a new application. I'm sure its worthy of a big ticket or fine.
I understand the law to say that you can have video screens in the car, but they are not supposed to be visible to the driver while the vehicle is in motion.

Now that this topic has gotten completely out of hand let me just say that I don't watch porn in my truck, but even if I wanted to nobody would know because the screens can't be seen from outside the truck as the windows are way dark.

i think most red blooded american males like some porn but its not right for kids to see it if its playing where it can be seen.its a felony to show porn to kids in california.i dont think people would be showing it if they knew what a legal mess they will be in.if i had a big boat parked out at the sand bar with video screens in it the porn would be saved for later-alot later.not when kids are playing frisbee behind the boat.
