These guys are clouding teh air in america. These guys are a true source of polution.... IN this case shoudl you be able to file suit or not file suit.

AP: TRENTON, N.J. -- Baseball fans can sue if they're hit by foul balls in the concession areas of New Jersey's minor league parks.
An appeals court said a Newark man who was hit in the face while buying a beer at Newark's Riverfront Stadium can sue the Newark Bears and the owners of the food service company.
The panel ruled that spectators assume some risk of foul balls flying into the stands. However, the judges said fans in concession areas have greater protection because they can "let down their guard."
An attorney for the food service company may appeal the ruling.

What pisses me off is that just an accusation can cost thousands and in most cases tens of thousands of dollars. Even if they win and defete the accusation. It is win win for the lawyers and both clients really lose.......

There needs to be a law passed where by the filers of frivilous lawsuits will be responsible for all legal costs on both sides if found guilty by the judge of doing so.
This shit would come to a screeching halt.

It will never hold up in court. That happened a while back I don't remember where. The judge simply said case dismissed. Spectators enter parks at there own risk. End of story. That guy is a little bitch just trying to make some quick cash. Loser should try busting some ass in life and maybe he will get somewhere. :yuk:

The guy would be stoned if he ever showed his face in a ball park. Just look what happened to the guy that interfered with the play in the cubs game.

This is classic "assumption of the risk" unless the person was hit in an area where one is unlikely to be struck.
But, "AOR" is a defense, not a bar to bringing a law suit.

Judges can "sanction" lawyers - i.e. fine them - and countersuits can be filed to recover court costs and attorney's fees if the suit is deemed frivolous.
Either way...I agree with the idea that this crap needs to be stopped. Didn't Shakespeare have a solution to this? As William Shakespeare said, "First of all, we hang all the lawyers."
