my father in law is in the process of buying a powertoon with a 496 in it assuming the noise is below the sound requirements with the silent choice , would that setup be acceptable with the LE......

I believe JB is correct, the exhaust that passes the test (thru the prop) can not be switchable to one that wouldn't, thru the transom.

I am going to third that. Switchable is no bueno. Either mufflers or well below the waterline.....
I think a "silent choice" type exhaust would be OK with LE only if it was under the db limit when routed through the transom
I don't think they are "illegal" to have, they do not qualify as a full-time muffling device. You still need to be in compliance with the system off.
