Thread: California stickers?

Alan, I didn't get either one of those stickers at renewal and this was just yesterday. Boat is an '05 Ski Sanger and I don't have that sticker on the back of my transom.
    Should I be concerned??
    Probably not.
I read through the bill and the law, and it's pretty hazy on whether every California boat owner has to put these on. From my read, I believe it's only applicable when the boat is sold, and even then, it's aimed at dealers and brokers.
.613. (a) When a new or used boat is sold in California, the
carbon monoxide poisoning warning stickers developed by the
Department of Motor Vehicles shall be placed both in the interior of
the boat where it is immediately visible to the person driving the
boat and on the back of the boat so it is visible to anyone occupying
    the water behind the boat.
    (b) For boats sold by a boat dealer, the dealer shall ensure that
both warning stickers have been affixed prior to the completion of
    the transaction.
    (c) For boats sold by individuals, both stickers shall be included
in the new registration material provided to the new owner, and the
new owner of the boat shall be notified that he or she is required to
affix one sticker in the interior of the boat where it is
immediately visible to the driver of the boat and a second sticker on
the rear of the boat where it is visible to anyone occupying the
    water behind the boat.
I don't read anything in the bill that says current boat owners must display the decals, or that CA authorities will be checking boats on the water. However, I'll be attending a conference the end of January with the heads of CA DBW, and will ask them what exactly the law requires.
    I'll post my findings here.
Even if it's not required, the law is doing its part by making people aware of the dangers and talking about the problem.

"611. It is unlawful to operate a motorboat or vessel, or run the
engine of an idle motorboat or vessel, when someone is occupying the
water within 20 feet directly behind that motorboat or vessel, or
when someone is occupying or holding on to the swim platform, swim
deck, swim step, or any portion of the rear of a boat.
    (a) "Occupying the water" includes, but is not limited, to
swimming, teak surfing, body surfing, or dragging.
    (b) "Teak surfing, body surfing, or dragging" shall be defined as
"holding on to any portion of the rear of the boat or surfing on the
wake behind the boat for any amount of time while the boat is
    underway at any speed."
    (c) A violation of this section is an infraction punishable by a
fine of up to one hundred dollars ($100)."

I think $100 is a little light........considering the danger that could result. But then again in the boat community one can drink and operate a boat a kill somone and get little jail time. I just don't think a sticker and a $100 fine is really going to discourage these people from teak surfing, etc. from the back of their boat.....Please keep use informed.

I have read the new law over and over, and they did a great job at making it vague. The law says that the decals will be provided to boat owners at registration time, but I failed to read where it says you must put them on unless you sell the boat.
Alan, thanks for looking into it for us and letting us know what comes out of the conference...

The way i read it is the decals must be "on the boat" when the boat is sold new (from dealer) and will be "mailed" to the new owner with registration when purchased used (private pary). I don't read anywhere in there that the decal must be in place or visable any time other then when the boat is being sold as new before it leaves the dealership.

I just registard my boat in November, and I have not gotten any of those lovely stickers, when I do get them I think I will put them above the crapper, seems that that would be the place for them.
