    this guy. besides the basic crap can anyone give me some ideas as to what else should be included in the leaseing of this business to protect myself it this guy does not make it.

    Yes a restaurante, oh i deff. am having a attorney re-write it and put it in the right terms but they miss and forget stuff too. i figured maybe someone has had a simmilar experience and could save me some headache

    Get him to provide a detailed financial statement, if you can get the lease secured/collateralized. VERIFY the assets being offered as collateral.
    PERSONAL GUARANTEE – with consent of spouse if in a community property state.
    Aggressive default remedies – Ex Parte receivership if possible
    PERSONAL GUARANTEE
    Forfeiture of lease upon default or bankruptcy petition.
    PERSONAL GUARANTEE
    If a sub-lease, make sure your tail isn’t on the line with original lessor if this guy goes b.k.
    And I almost forgot…. PERSONAL GUARANTEE.
